MakerNexus is fully committed to promoting children's/minor's rights, notably their right to be protected from harm, abuse and exploitation and to be involved in any decisions that directly affect them.
MakerNexus has a duty of care to implement effective policies and procedures for safeguarding the welfare of children and young people.
In order to achieve this we will ensure our staff and volunteers are carefully selected, screened, trained and supervised.
Furthermore we will endeavor to keep up to date with laws and regulations relating to the care and protection of children and young people.

MakerNexus will:

== Child/Minor Protection Procedures ==

=== Introduction ===
Child Protection Policy and Procedures reflects the commitment and aims to ensure that all concerns about the care and protection of children and young people are effectively managed. All staff and volunteers are required to implement the child protection procedures.

The MakerNexus Board of Directors reviews and updates these Policies and Procedures along with the General Manager at least once per 3 years.

=== Recruitment ===
MakerNexus recognizes that appropriate recruitment and selection procedures are a vital part in developing and maintaining a safe environment for children and young people. The following procedures are in place to ensure that only suitable applicants are accepted as volunteers or staff:
* All applicants (staff and volunteers) will be asked to complete an application and a self declaration form. Self declaration form will be used so that interviewed applicants can declare and discuss any background issues (and their context) with the organisation.
* All successful applicants (paid and unpaid positions) will be asked to provide suitable references.
* All applicants are subject to a background check.

=== Training ===
All newly appointed staff and volunteers at MakerNexus will receive training, support, information and guidance to ensure they understand their role and responsibilities with regard to Child Protection. This will include:
* Details of the structure of the organisation will be provided, including the details of overall responsibility for child protection within the organisation
* The roles and responsibilities of staff and volunteers within the organisation will be clarified as it relates to the child protection policies and procedures.
* Clear details of the expectations, roles and responsibilities of all newly appointed staff and volunteers will be provided
* All staff and volunteers must agree to the organisation's [[Ethics and Conduct]] and Child Protection Policy and procedures
* All staff and volunteers are to be trained

=== Responding to Suspicion or Allegation of Abuse ===
Members of staff (paid and unpaid) or volunteers have a duty to report any suspicions, allegations or disclosures to the General Manager.
However, the first concern must be the reassurance of the child or young person and their protection from any potential risk.
During the reporting process the young person should be protected from further contact with the individual involved in the allegation.
As a worker or volunteer your role in child protection is not to investigate or decide if abuse has taken place.

The following steps should be followed immediately in response to suspicion or allegation of abuse:

Detailed written records should be made of all events and what the young person or other individuals have said (where this applies). Fill out an Incident Form and turned in to the General Manager. Above and beyond the facts,
any opinions or personal interpretations of the facts presented can be recorded but it should be clear they are opinions, rather than facts.

=== Responding to a Child Reporting Incident/Abuse ===
It is likely that a child or young person who has been abused will have given a lot of thought as to whether they should disclose the abuse. It is highly likely that they will be nervous and afraid that they might be rejected, blamed or not believed. It is important that staff and volunteers follow the steps outlined below:

==== Stay calm ====

Remain calm and natural. You have been approached because you are trusted, not because you are an expert counsellor. Do not promise to keep the information secret; you may have to inform an appropriate person. You must take any disclosure seriously and reassure the young person that you believe them.

==== Listen and take the allegation seriously ====

Listen to what the child or young person is saying. Give them the time and opportunity to tell you as much as they are able and willing to. Do not pressure them and allow them to disclose information at their own pace. You should not investigate, ask leading questions or ask specific or explicit questions. You should only clarify what they are willing to tell you in their own words. Try to do this in an appropriate place, such as a room where other people can see in through an open door or window. While it's important to respect the young person's privacy it should not be at the expense of other child protection measures.

==== Reassure ====

Reassure them that you believe what they are saying and that you know it is not their fault. You should also give them some indication of what you will do next with the information that they have given you.

==== Confidentiality ====

Reiterate that you cannot promise to keep the information secret. You must take any disclosure seriously. Details of the disclosure should only be passed on to the General manager, who should refer the case to the appropriate authorities.
Wherever possible you should try not to discuss any concerns that you have about a child or young person in a way that may lead others to suspect that they are being abused.

==== Record ====

If you are able to, make brief notes during the initial disclosure, explaining to the young person why you are doing it. If it's not possible to do so at the time, record the details as soon as possible after the disclosure with as many facts as possible (dates, times, actual words used).
Use an 'Incident Form' to record the information when referring information to the General Manager.

====Look after Yourself====
Being trusted with a disclosure of abuse directly from a young person can be emotionally draining, worrying and very stressful. While it's essential that confidentially is maintained at all times, it's important that you consider your own emotional feelings and discuss any anxieties you have with the General Manager or Volunteer Coordinator.

=== Data Protection ===
MakerNexus is committed to the safe and secure management of confidential information. All personnel information, including volunteer information, is kept locked and can only be accessed by those that require it to carry out their role. Only relevant information is kept and this is regularly reviewed and outdated information destroyed appropriately.

MakerNexus is also committed to the rights of children and young people to confidentiality and this will be respected by all workers and volunteers. However, where a worker or volunteer feels that the information disclosed by a child or young people should be referred to the General Manager, the young person should be told that confidentially cannot be kept.

=== Understanding of Abuse ===
Abuse to children or vulnerable young people is described under the following headings:

==== Neglect ====
The persistent or severe neglect of a child or young person, whether wilful or unintentional, which results in serious impairment to physical heath and development. For example:
* exposing a child to extreme weather conditions e.g. heat and cold.
* failing to seek medical attention for injuries.
* exposing a child to risk of injury through the use of unsafe equipment without proper supervision.
* exposing a child to a hazardous environment without a proper risk assessment of the activity.
* failing to provide adequate nutrition and water.
Signs which may raise concerns about physical neglect include:
* constant hunger
* poor personal hygiene and/or poor state of clothing
* constant tiredness
* untreated medical problems
* low self-esteem

Actual or attempted physical injury to a child or young person where there is definite knowledge or reasonable suspicion that the injury was inflicted or knowingly not prevented. For example:
* Deliberately hitting, shaking, throwing, poisoning, burning, scalding, drowning, suffocating or otherwise harming a child.
Signs which may raise concerns about physical abuse include:
* refusal to discuss injuries
* aggression towards others
* improbable excuses given to explain injuries
* avoiding activities due to injuries or possibility of injuries being discovered

==== Emotional Abuse ====
The adverse effect on the behaviour and emotional development of a child or young person, caused by failure to provide for their basic emotional needs. For example:
* Persistent failure to show any respect to a child (e.g. continually ignoring a child)
* Constantly humiliating a child by telling them they are useless.
* Continually being aggressive towards a child, making them feel frightened.
* Acting in a way which is detrimental to the child's self-esteem (e.g name calling, sarcasm, constant criticism)
Signs which may raise concerns about emotional abuse include:
* low self-esteem
* significant decline in concentration
* indiscriminate friendliness and neediness
* extremes of passivity or aggression
* self-harm
==== Sexual Abuse====
Any child or young person below the age of 18 may be deemed to have been sexually abused when any person, by design or neglect, exploits the child or young person directly or indirectly, in any activity intended to lead to the sexual arousal or other forms of gratification of that person or any other person including organised networks. This includes forcing or enticing a child to take part in sexual activities whether or not they are aware of or consent to what is happening. Sexual abuse may involve physical contact, and non-contact acts such as forcing children to look at or be involved in the production of pornographic material, to watch sexual activities or encouraging them to behave in sexually inappropriate ways. For example:
* exposure to sexually explicit inappropriate language or jokes.
* showing a child pornographic material or using a child to produce such material.
* inappropriate touching
Other abusive behaviour towards children and young people
Staff, volunteers and committee members should also be aware of other, perhaps less obvious, forms of abuse. These may be dismissed by perpetrators as 'just fun' or 'having a laugh' with young people but can have a serious impact and cannot be allowed or go unchallenged:
* Bullying of any form, including name calling or constant criticism
*'Picking on' a young person because of their family background, manner of dress or physical characteristic
* Racism or sectarianism if any form
* Favouritism and exclusion - all young people should be equally supported and encouraged
* Abusive language or gestures

== Guest and Minors ==
* Members are responsible for guests and/or minors and their actions.
* Guests are encouraged to become members.
* Guests are not allowed to use tools and equipment, except as part of a scheduled class/workshop.
* Minors must be accompanied closely by a legal parent or guardian. This includes scheduled class/workshops unless there's special provision to manage unaccompanied minors. 'Accompanied closely' means visual range generally, and immediate reach when near dangerous equipment.

== Creating a Safe Space for All ==
Please maintain situational awareness at all times to insure there is no potential to injure yourself or others.

Safety takes many forms.

The following constitute grounds for explusion without refund.
* Violating any federal, state, or local laws, facility rules.
* Failure to comply with the instructions of Staff
* Using anything in a threatening or destructive manner against person or property
* Endangering the safety of oneself or others
* Threatening, stealing, cheating, hazing, stalking, harassing or otherwise treating others other than excellently.
* Failure to conduct oneself in a mature manner.
If you experience or witness any of the above, speak up and politely explain to those violating what behavior was unacceptable. Address issues immediately. Alert Staff to the situation.

===No Harrassment Policy===
MakerNexus is dedicated to providing a harassment-free experience for everyone, regardless of gender, sexual orientation, disability, physical appearance, body size, race, religion, or affiliation. It is a most basic form of safety, and we will not tolerate harassment or racism in any form. It is grounds for expulsion without refund.
This includes:
* Offensive comments related to race, religion, gender, gender identity and expression, sexual orientation, disability, or physical appearance
* Gratuitous sexual or obscene images or behavior in spaces where not appropriate
* Unwelcome physical contact or sexual attention without consent or after a request to stop
* Threats or incitement of violence towards any individual, including encouraging a person to engage in self-harm
* Deliberate intimidation by words, gestures, body language, or menacing behavior
* Stalking
* Harassing photography or recording, including logging online activity for harassment purposes
* Continued one-on-one contact or communication after requests to cease
* Deliberate "outing" of a sensitive aspect of a person’s identity, health, history, etc without their consent
* Deliberate misgendering. This includes deadnaming or persistently using a pronoun that does not correctly reflect a person's gender identity

===Non Descrimination Policy===
MakerNexus does not promote or discriminate against any person, population group, or organization with regard to categories protected by applicable United States law. These include, but are not limited to race, color, religion, sex, gender expression, physical appearance, language, education background, national origin, age, disability, and veteran status.

===Preparing for Safety===
Do not engage in behaviors or actions that infringe on the rights of other or/and a safety issue to self or others.

Preparing for Safety includes but is no limited to
* No animals on premise. Please don't leave animals in cars, it's often not safe for them there either. Service animals as defined by the ADA may be allowed as long as the animal and owner are in a safe part of the makerspace. Owners of a service animal must note that normal makerspace activities can include sudden loud noises and flashes of light and ground shaking that can upset even a well trained Service Animal. Owners should consider other options before bringing their service animal into the makerspace.
* Mimimize distractions, turn off cell phones, etc.
* No being under the influence of intoxicating substances on premise.
* No being under the influence of any substance the impairs the members ability to safely use the equipment. This includes over the counter medications that may cause drowsiness or other affects that are inappropriate to a safe working environment.
* No smoking, cigars or vaporizers on premise.
* No excessive scents, perfume or body odor.
* Wear appropriate clothes. Additional requirements may be depend on the area of work. This may include safety glasses, hair containment, shirt sleeves, removal of jewelry, rings and others.
* Don't use gloves near power tools. They can be used to move materials to work areas.
* No open toe shoes.
* Respond to alarms and exit the facilities as soon as possible in a safe manner.
* Follow posted notices.
* Follow Staff direction.
* Excessive or distracting and disturbing noise other than necessary for facilities use and safety. No shouting or loud music.
* Don't leave items unattended.
* Obstruct the use of the resources by obstruction, by theft or deliberate misplacement of resources. No borrowing.

Inability to follow the guidelines outlined is grounds for review for expulsion. 
You will be held responsible for repeated or willful stupidity.

And, if you see anyone being particularly smart, careful and safe, please take a moment to provide a Thumbs Up! positive reinforcement if you aren't interrupting, or even mention it to the staff.

===Makerspace Facilities, Equipment and Shop Safety===

* If you aren't authorized to use a piece of equipment or material, don't use it.
* If you aren't trained on the proper use of a piece of equipment or material, don't use it. Get trained or ask for help by someone who is.
* If you are unsure how to do or use something safely, don't do it. Ask for assistance.
* No manufacturing of firearms or any item covered by the National Firearm Act.
* No manufacturing of fireworks or other items requiring specialized license without specific written authorization of the General Manager and the Board of Directors. Do not expect this authorization to be given.
* Report any injuries immediately. We're required to keep such records for the insurance company coverage and to review for safety improvements.

==== Use the Right Tool ====

* Keep equipment and tools in good working order.
* Don't talk to or distract persons working equipment or materials. Their safety depends on their focus to the task.
* Don't abuse, deface, or deliberately damage the facilities, equipment, materials and resources, both tangible and intangible.
* Report all broken or malfunctioning equipment, tools, etc. We can't fix it if we don't know about it. If you broke it, immediately report so it can be fixed quickly. It's Ok, breakage happens. If perhaps you need more training to avoid issues in future, no problem. The more immediate the training, the more likely you are to retain it for future use. Learning is part of a maker space.
* Don't use the equipment beyond recommended usage and tolerances without expert knowledge and appropriate mitigations. When in doubt, ask.
* Don't use dangerous equipment alone. Use the buddy system. Ask around if someone is free to keep an eye on you if you forgot to bring one with you.
==== Materials Management ====
* Be aware of your project as it moves through equipment and keep clearance in relation to yourself, others and other areas. For example: long poles and boards as they are pulled thru equipment may be thrown.
* Ensure materials move around the facility and are stored in a safe and approved manner.
** Don't walk thru the maker space with something dangerous (acid, etc) that's easy to spill. Put a lid on it.
** Don't store an acid in something it can eat thru sometime late at night when nobody is around. Keep it in an approved container.
** Don't store a flammable in an open container. Keep it in an approved container.
* Don't catch fire, don't set fire to others or to items that were not designed or designated to be set alight.
* Some materials are not appropriate to certain machines, and sometimes inappropriate to the makerspace entirely. Consult the [[MaterialsManagement |materials management]] or [[CaribbeanEquipment | equipment pages]] in the wiki for expanded information.

==== Clean Up ====
* Keep equipment and areas clean (this is part of safety too) every time you leave the equipment.
* Learn what clean means and leave an area that clean or cleaner than you found it.
* If you don't know how to clean something, ask for assistance. Leaving it because you don't know is not an excuse.
* Give yourself enough time to clean up before you need to leave.
* Don't use a rag around moving equipment.
* Put things back where they belong, if you don't know, ask for assistance.
* Can't get it clean? Need cleaning supplies? Ask for assistance.
* Use a brush or other tool to clear chips and shavings, never your hand.

=Incident Review and Remediation=
As with any group, disagreements happen. Mistakes happen. Members and Guests are expected to learn, discuss concerns and differences, and resolve issues in a calm and polite manner. Strive to see all sides of a situation, and use reasonable effort to resolve issues immediately.

If someone points out something wrong with your conduct, stop, take steps to insure immediate safety, clarify the issue and adjust.
If you can't come to a conclusion on the situation, reach out to staff for assistance.

The MakerNexus community will strive to
* make it as easy as possible to do the right thing to stay safe.
* make mistakes a normal part of learning processes.
* make resolution clear and as quick and fair as possible.

Staff will review the details of the situation and make the call on request for adjustment to behavior of any involved. If asked, they will write up the basic circumstances and the ruling on outcome at the time for later review. Copies are given to parties in the incident within 2 business days.
Immediate actions may include but are not restricted to:
* Discuss current policy and requirements with all the parties.
* Immediate training on safety or usage.
* Require actions of the person(s) such as cleaning up space, change specific behavior, remove items from the premises.
* temporary removal of person or persons from a piece of equipment or activity. Perhaps additional training or safety review is required before return to the equipment, or barred from the equipment reservation for a day. Repeat offenses may include a week, a month or more. There are no refunds for removal.
* temporary removal of person or persons from premises (facility or grounds) for the day. Perhaps review of the Ethics and Conduct with the General Manager is required for return. Repeat offenses may invoke a week, a month or more. There are no refunds for removal from the premise for cause.
Those who don't abide by the ruling can appeal, and are expected to conform to the ruling until appeal is complete.
Any appeals are required to be made in writing (email accepted) to the General Manager received within 2 business days.

Incidents will be reviewed by the General Manager within 3 business days.
The General Manager will review any associated appeals made within that time and may make adjustments to the requirements.
Changes will be notified to all involved, including staff members.
The General Manager will determine if any temporary removal from premises should be forwarded to the Board of Supervisors
for consideration of making a removal permanent.

The Board of Supervisors will review considerations for removal. They may discuss with the staff, General manager and persons in question and then make a ruling within 2 weeks. There is no membership refund for permanent removal from the premises, there is no re-application accepted for reconsideration in less than 1 year.

Incident tracking will be maintained for reference for at least 3 years.

Decisions should be reviewed periodically by the Board of Supervisors for larger issues, trends and improvements in the Ethics and Conduct as well as other policies.

Finally, a continued dispute or disagreement arising between the Member and Maker Nexus shall be resolved by arbitration in California before one arbitrator and arbitrated in accordance with the Commercial Arbitration Rules (the "Arbitration Rules") of the American Arbitration Association (the "AAA"), in effect on the date that such notice is given.

The Board of Maker Nexus reserves the right to alter or amend the rules as it determines appropriate for the safety of Maker Nexus members.

:A deadname is the birth name of a person who has since changed their name (especially a transgender person). Deadnaming is refusing to call a person by their name, only by their deadname.

: Any part of the building and grounds, inside, out and the parking lot. Some activities may by necessity and safety are outdoors.

; harrassment
:The act of systematic and/or continued unwanted and annoying actions of one party or a group, including threats and demands.

; equipment
: Something used to create or manipulate objects, be they software or hardware. This may include but not limited to: lathe, hammer, screwdrivers, sewing machines, scissors, pencils, tables, saws, and sandpaper. Some equipment may also be materials such as computers based on usage and intent.

Make at home face masks

Face masks are used to help prevent the spread of the disease. These masks are worn by people who are infected, or might be infected. You should wear one if you are coughing or sneezing.

Our local hospital is keeping the official paper masks for their staff. They want to give one of these to every patient who walks in the door.

These masks are made of cotton. They have elastic or ties that go around the ears or tie around the head. They are washable.

You can make these at home with a sewing machine.

Natural fiber cloth, like cotton. Hospitals do not want masks made of used cloth (no old t-shirts or sheets, please).

* 2 yards of material, cotton fabric approx 42” width will make 24 Adult style.

* You will need an est. of 9 yds of Elastic.(1 yd for front and 1yd for back)

* Maker Nexus can provide 2 yards of fabric (1 for the interface and 1 for the outside), plus elastic to use for making 24 masks. If you know how to use a piece of equipment, we offer a short checkoff test with a proctor. You may arrange for a test by talking with any staff members or by posting on the appropriate Slack channel (e.g. #lasercutters, #textiles, #3dprinters)

If you need to learn to use a piece of equipment, no problem - we'll teach you! We offer Basic Operation and Safety Standard (BOSS) classes for all our equipment. If you know how to use a piece of equipment, we offer a short checkoff test with a proctor. You may arrange for a test by talking with any staff members or by posting on the appropriate Slack channel (e.g. #lasercutters, #textiles, #3dprinters)

If you need to learn to use a piece of equipment, no problem - we'll teach you! We offer Basic Operation and Safety Standard (BOSS) classes for all our equipment. History of the decision:

We initially asked anyone who signed up as a member to pick one or more of the following locations: Menlo Park, Santa Clara, Newark. In late January the votes were pretty clear: 85% of the pledged members approved of Menlo Park; 62% Santa Clara; 40% Newark (Some people selected more than one location that was acceptable to them).

==Things We Need==
Our makerspace needs so many things. We list a few items here that would be nice to have. Perhaps you could buy something off the list and donate it? You could [mailto:regina.sakols@makernexus.org contact Regina] to make sure someone else hasn't already purchased the item.

* Office trash cans (10)
* 8 large MagLite flashlights with wall mounts. We'll put them in rooms in case of power failure.
* 10 soldering fume extractors. We'll put two in the main room and use the rest when we teach classes
* 5 silent wall clocks, battery powered, to put around the makerspace. They can't be ones that make a loud ticking sound - that would drive everyone crazy.
* 3 Windows laptops for our staff. Ones that cost in the range of $500-600 would be good enough.
* 10 laptops or chrome books for our education program.

==Helping Others==
* Sponsor a Maker - We have some members of our community that can not afford the $150 monthly membership. We would like to offer them a scholarship, but we don't have the funds yet to do that. You could help by sponsoring a membership. You could offer to pay half of someone's monthly membership for a year, the whole membership, or some other program that suits you. Contact us and we can discuss some options.
* Sponsor a Student - We sometimes hear from a person who would like to take one of our classes but cannot afford the class fees. We are unable to provide these classes for free at this time. You could help by donating to a scholarship fund. Classes can cost between $60 and $200. We will use your donation to provide a class to someone at either no-cost or at a reduced cost.
* Youth STEAM Camp - Our one week long STEAM camps for teens give them experience with a variety of maker tools. Some are about robotics, some are about woodshop, some are a whirl wind exposure to a number of different parts of the makerspace. The cost is about $1,000 per student including materials. You could help by sponsoring a student, or even an entire class of 10 students. If you want a special curriculum, we could do that too. For example, Amazon Lab126 sponsored an extensive 2 week drone delivery challenge in 2018 for 20 students.

Maker Nexus is a non-profit with a mission to provide education in woodworking, textiles, metalworking, and other vocational skills and hobby crafts, and promote the same in the community. We will do this by providing a community makerspace that serves all experience levels from hobbyists to professionals. Our goal is to help each person improve their skills whether as STEAM/STEM teen, life enrichment, job skill acquisition, or new entrepreneur.

==Maker Memberships==
We offer Maker Memberships that give access to the shop. (Different than a non-profit "membership" where you are really just donating to support the mission.) Maker Memberships will not be tax-deductible even when we get our 501(c)3 status.

We have considered other Maker Membership levels that would cost more and give access to more equipment hours per week, or access to specialized equipment. We have called these levels "Pro" and "Start Up" but we have not come to any hard decisions. Your feedback will help us design these to suit the community best.

==The Town Halls==
The 6 member Maker Nexus (MN) board has been working on our plan since the day TechShop closed. We've had the help of several other people. We would be happy to have a board member speak to any group that is interested in our new shop.

* March 28, 2018: We appreciate the [https://www.hbrobotics.org/ Homebrew Robotics Club] for letting us talk at their monthly members meeting. It's a spirited group of people, passionate about home built robots. The meeting was very interesting. The [https://goo.gl/mDCSfs presentation is online].

A great location for a meetup like this (with some great maker-like photographic art on exhibit). About 35 people were there with 10 new people. * January 28, 2018: We held our second town hall. (Thanks to [https://altoschool.org/ Alto International School). About 40 new faces showed up. It was a lively crowd with a lot of laughs and questions. This community is really amazing.

History of the decision:

We initially asked anyone who signed up as a member to pick one or more of the following locations: Menlo Park, Santa Clara, Newark. In late January the votes were pretty clear: 85% of the pledged members approved of Menlo Park; 62% Santa Clara; 40% Newark (Some people selected more than one location that was acceptable to them).
